Terms & Conditions

Effective as of May 1st, 2025

 

Welcome to Mountain Explorer Co. We are proud to offer transportation-based sightseeing experiences throughout Banff National Park and the surrounding Canadian Rockies. Please read the following terms and conditions carefully before booking your tour with us.

Pricing

All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes, including 5% GST. Prices are subject to change without notice.

  • A mandatory Parks Canada Moraine Lake Road Access fee of $6 CAD per person is included in your booking.

  • A separate payment processing fee is charged directly by FareHarbor at the time of booking.

  • Third-party booking platforms may apply their own fees; please contact them directly for inquiries.
     

Payment & Booking

All bookings must be made through our official partner platform, FareHarbor. Full payment is required at the time of booking. We accept Visa, Mastercard, American Express, and other major credit cards via FareHarbor’s secure checkout system.
 

Cancellations & Modifications

  • Cancellations or modifications must be made at least 72 hours prior to departure to receive a refund, minus the non-refundable FareHarbor booking fee.

  • Cancellations or changes made within 72 hours of departure are non-refundable and cannot be rescheduled.
     

Missed Departures
Guests who miss their departure time for any reason, including arriving late to the designated pick-up location, will not be eligible for a refund. Guests are responsible for being on time at every designated departure point during the tour, including scheduled pick-ups from the lakes. If a guest misses a shuttle back, they must arrange their own transportation at their own expense.
 

Cancelled Tours by Mountain Explorer Corp.

  • If Mountain Explorer Co. cancels a tour (due to weather conditions, road closures, mechanical issues, insufficient bookings, or other factors), a full refund will be issued.

  • Some tours require a minimum number of participants. If this minimum is not met, we reserve the right to cancel the tour with notice and provide a full refund.
     

Force Majeure
Mountain Explorer Co. is not liable for delays, cancellations, or service interruptions caused by events outside our control, including but not limited to: extreme weather, natural disasters, government actions, pandemics, or emergencies. No refunds or compensation will be issued unless otherwise stated.

Legal Jurisdiction
These terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. By booking with us, you consent to the exclusive jurisdiction of the courts located in Alberta, Canada.
 

Liability Waiver
By participating in a Mountain Explorer Co. tour, you acknowledge that you are engaging in a recreational activity involving transportation in mountain environments, which carries inherent risks. You agree that Mountain Explorer Co., its employees, owners, and affiliates are not liable for any injury, loss, accident, delay, or irregularity during transportation, stops, or while on foot.

  • Mountain Explorer Co. primarily provides transportation services. Any activities beyond transportation, including but not limited to hiking or exploration, are undertaken at the guest's own risk.

  • Complimentary drinks and optional lunch boxes are offered; however, we cannot guarantee allergen-free preparation and accept no responsibility for allergic reactions or food sensitivities.

  • We are a transportation-based sightseeing company and not licensed for backcountry guiding.

  • Guests who explore beyond designated areas or venture into backcountry trails do so at their own risk.

  • You release Mountain Explorer Co. from all claims, liabilities, or damages, except in cases of gross negligence.

  • If any part of this Liability Release is found unenforceable for any reason, the total liability of Mountain Explorer Co. will be limited to the lesser of the total price paid for the service provided.
     

Insurance
Mountain Explorer Co. maintains all required commercial vehicle and liability insurance as mandated by Alberta law. However, we strongly recommend that guests purchase personal travel and health insurance to cover unexpected events, injuries, or cancellations.
 

Media Consent
By participating in our tours, you grant Mountain Explorer Co. permission to capture photos and videos of your group, which may be used for promotional purposes, including social media, website, and marketing materials.

  • If you do not wish to appear in any media, please inform your guide prior to the start of the tour.
     

Travel Policy

  • Children under the age of 6 cannot be accommodated on any of our tours.

  • Guests under the age of 18 must be accompanied by an adult.

  • All guests must be able to board and disembark from the vehicle without assistance. Please notify us in advance of any special mobility requirements.

  • Mountain Explorer Co. operates within national park boundaries and complies with all Parks Canada regulations.

  • Travel conditions in the Rockies can change rapidly; weather, wildlife, or trail conditions may alter itineraries without notice.

  • Tours operate in all weather conditions, including rain, snow, cloudy skies, or smoke. No refunds will be issued due to weather conditions outside the 72-hour cancellation window.

  • Guests must remain on clearly marked trails and avoid restricted or unmaintained areas. Your safety is our priority, but each guest is responsible for their own preparedness and behavior during free exploration time.
